Information and Overview |
|
Trees are easily the most
controversial issue involved with new home construction in Wolf Laurel.
The ARB will consider your proposed Site Plan in light of the trees it
would destroy, and approve (or disapprove) accordingly. You are NOT
required to submit a Tree Removal Plan for trees within the Construction
Footprint. If, and when, the ARB approves your application, you are
authorized to remove any or all of the trees within the Construction
Footprint.
You MUST submit a Tree Removal Plan if you wish to remove trees which
are outside of the Construction Footprint, and which are eight (8) inches
in diameter or greater at three (3) feet above ground level.
Your Tree Removal Plan may be incorporated in or otherwise related to
your Site Plan. It must indicate the location and diameter of every
tree you wish to remove which is eight (8) inches in diameter or greater
at three (3) feet above ground level.
Disapproval of your Tree Removal Plan does NOT necessarily mean
disapproval of your entire application. The Wolf Laurel ARB often
disapproves extensive Tree Removal Plans while approving the associated
construction project. |

Whereas the natural beauty of Wolf
Laurel Resort is one of its greatest assets, certain rules and regulations
concerning the cutting of trees must be established and enforced.
The following guidelines and regulations below will be set and enforced by
the ARB. |

Tree cutting at Wolf Laurel that
falls within the guidelines in the next section must be approved in
advance via written application with supporting documentation as required.
The lot owner is responsible for abiding by these rules and regulations.
Applications may be obtained from the ARB Administrator. The ARB
will respond in a timely manner. In the case of a damaged tree an
application may be marked "emergency" and will be expedited as soon as
possible. |

NO TREE MAY BE CUT THAT IS OVER
EIGHT (8) INCHES IN DIAMETER MEASURED THREE FEET ABOVE THE GROUND OR THAT
IS FURTHER THAN TWENTY (20) FEET FROM THE FOOTPRINT OF THE HOUSE OR
GARAGE. Trees may be cut to provide for a driveway. Any single
tree violation may subject the lot owner up to a $100 fine per day until
reforestation has been completed and approved by the ARB. Any mass
cutting, to be defined as the cutting of more than six trees in violation
of these regulations, will be considered mass or clear cutting. The
lot owner may be fined $100 per day until reforestation has been completed
and approved by the ARB. Contractors may be barred from doing
business within Wolf Laurel. In either instance mandatory
reforestation of similar trees of a future height equivalent will be
required at the lot owner's expense. If any said fines are not paid,
or reforestation not in place, a lien may be placed against the said
property. |

A tree cutting plan indicating the
location of trees to be cut must be submitted and approved by the ARB
before clearing or construction may begin. |

The topping of trees without ARB
approval is prohibited. The cutting of lower, diseased, or dead
branches that does not endanger the tree is allowed without prior
approval. |

Tree cutting debris including all
logs must be consumed or managed on owner's property or removed from Wolf
Laurel. NO DUMPING OF LOGS OR DEBRIS ON VACANT LOTS OR IN THE
ROADWAYS OR DITCHES IS PERMITTED. Such dumping may subject the lot
owner to a $100 fine per occurrence per day and costs of cleanup. |

Tree cutting on lots with existing
houses will be subject to the same regulations and application process as
for new construction. |
|

ü |
If a tree on an existing lot has
been damaged or is threatening a structure, a waiver may be requested from
the ARB for the removal of said tree. |

Dead trees may be cut and consumed
or removed from property, as this is good woodlands management. If
the tree(s) in question is over eight (8) inches in diameter prior
approval by the ARB is required before cutting. |
